These Terms of Service ("Terms") govern your use of Growvya — the website growvya.co.in, the application at app.growvya.co.in, and related services (together, the "Service"). Growvya ("we", "us") is operated from India; you can reach us at support@growvya.co.in. By creating an account or using the Service you agree to these Terms.
Growvya is a software platform that lets businesses send marketing communication over WhatsApp and email to their own customers, with AI-assisted campaign writing, scheduling, and delivery analytics. We are a software provider: campaigns are created, reviewed, and approved by you, and are sent on your behalf to your own customer list. Nothing is sent without your approval.
You must provide accurate information when registering, keep your login credentials secure, and be at least 18 years old and authorised to act for the business you register. You are responsible for all activity under your account.
Growvya is built for legitimate marketing to customers who have agreed to hear from you. You agree that:
We monitor bounce and complaint rates. If your sending exceeds industry-standard thresholds (approximately 5% bounces or 0.1% complaints), we may throttle, pause, or suspend sending to protect all customers on the platform.
WhatsApp marketing messages are sent using templates that must be approved by Meta; we cannot guarantee approval or approval timing, and Meta's own charges and rules apply and may change. Email is sent through reputable infrastructure with mandatory unsubscribe links. Delivery, open, and read information is shown where the underlying platforms make it available, and is not guaranteed to be complete.
The AI Campaign Writer produces drafts. You are responsible for reviewing, editing, and approving all content before it is sent, including its factual accuracy and legality. AI output may contain errors; the "Generate → Review → Approve → Send" flow exists precisely so nothing goes out without your sign-off.
Paid plans are billed as a recurring subscription (via Razorpay) at the prices shown on our pricing page, exclusive of GST, which is added where applicable; a GST invoice is issued for every payment. Each plan includes monthly allowances (contacts, emails, WhatsApp messages, AI generations) that reset on the 1st of each month and do not roll over. WhatsApp usage beyond your allowance requires prepaid top-up credits. You can cancel anytime; see our Refund & Cancellation Policy. We may change plan pricing with at least 30 days' notice; changes never apply retroactively to a period you have already paid for.
Your contact lists and campaign data remain yours. We process them only to provide the Service, as described in our Privacy Policy. We do not sell your data or your customers' data, and we do not use your contact lists for any other customer.
You may stop using the Service and cancel at any time. We may suspend or terminate accounts that violate these Terms — in particular the consent requirements in Section 3 — or that create legal, security, or deliverability risk for the platform. Where reasonable we will warn you first. On termination you may request an export of your contact data within 30 days.
The Service is provided "as is" and "as available". We depend on third-party platforms (Meta/WhatsApp, email infrastructure, payment providers) whose availability and policies are outside our control. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the three months preceding the claim, and we are not liable for indirect or consequential losses, including lost profits or lost business.
We may update these Terms; material changes will be notified by email or in-app at least 15 days before taking effect. Continued use after that constitutes acceptance. These Terms are governed by the laws of India, and courts in India shall have jurisdiction.
